What happened

Jamarco McShann was fatally shot by Moraine, Ohio police officers Jerry Knight and John Howard on October 20, 2017, after officers responded to a complaint about loud music coming from a running car at an apartment complex. Police found McShann asleep behind the wheel with a handgun in his lap. Officers approached, awakened him and instructed him to keep his hands raised and away from the gun. According to the officers and a later federal appellate opinion, McShann reached for the firearm and moved it toward officers at the driver's door, prompting Knight and Howard to shoot him. His estate sued, challenging the force as unconstitutional. In February 2021, the Sixth Circuit affirmed summary judgment for the officers, agreeing that the shooting was objectively reasonable on the record before the court. The opinion carefully examines the seconds between waking McShann and the shots, emphasizing the unusual circumstances of a person abruptly awakened while armed.
