What happened
Curtis Jamal Deal was fatally shot by Baltimore police officer David Kincaid Jr. on February 7, 2017, after a foot pursuit near Frederick Avenue and South Monroe Street. A later federal court opinion recounts that both men had drawn firearms and that Kincaid fired after Deal turned and raised his gun in the officer's direction. Deal was struck three times in his hip and torso. His estate alleged that Deal remained conscious after the shooting, pleaded for help and told Kincaid he did not want to die, but was handcuffed while immediate medical assistance was delayed. Those claims formed a separate constitutional dispute about aid after the use of force, in addition to the shooting itself. The estate sued Kincaid; in March 2021 a federal district judge dismissed the initial complaint while allowing the estate to amend its federal civil-rights claim. Dismissal of an initial pleading with permission to amend is not an adjudication of all allegations, and the estate's account of the delay is attributed as a claim.
