What happened

At Brooklyn's Rockaway Avenue subway station on May 5, 2013, Deion Fludd and his girlfriend were confronted by officers over an alleged fare-evasion incident. He fled into a subway tunnel. Police maintained a train struck him; Deion and his family alleged officers assaulted him, causing devastating spinal and head injuries. He was left quadriplegic and received prolonged hospital care before his July 12 death. His mother Karen Fludd filed a lawsuit alleging excessive force, battery, wrongful death and other claims. In a 2021 appellate opinion, a New York court discussed the procedural disposition of several claims without conclusively resolving the contested physical cause of his injuries.
